Preamble

The present conditions of sale are agreed between, on the one hand, Klara J. headquartered at 8 rue des Genêts in Castelnau-le-Lez (34170) - SIRET : 523 490 647 00022 - RM : 34 - hereinafter referred to as “Klara J.” managing the site https://www.klaraj-shop.com/ and, on the other hand, any natural person or legal entity willing to make a purchase through the website https://www.klaraj-shop.com/ hereinafter referred to as “the Buyer”.

Article 1: Object

The present general conditions of sale have for object, on the one hand, to inform any possible consumer about the terms and conditions under which the seller carries out the sale and delivers the products ordered, and on the other hand, to define the rights and obligations of the parties in the context of the sale of products by the seller to the consumer which applies, without restriction or reservation, to all sales, by Klara J., of the products offered on its website https: //www.klaraj-shop.com/ as well as any operation necessary for their execution.

Consequently, the fact that any person orders a product sold on the Klara J. website implies full and complete acceptance of these general conditions of sale, which the Buyer acknowledges having read before ordering. These conditions apply to the exclusion of all other conditions, in particular those which are in effect for in-store sales.

These conditions are accessible to everyone on the commercial website https://www.klaraj-shop.com/. Klara J. reserves the right to modify these general conditions at any time, subject to these changes appearing on its website. These changes are effective from the moment they are posted online and cannot be applied to contracts concluded previously. Each purchase on the site is governed by the Conditions applicable on the date of the order.

Article 2: Scope of application

These general conditions apply to all the sales of Products by the seller to the Buyer, made through the website. An order will only be taken into account by the seller after prior acceptance of the conditions by the Buyer.

Article 3: Products

In accordance with article L 111-1 of the French Consumer Code, the Buyer may, prior to his order, be informed, on the website https://www.klaraj-shop.com/, with the main characteristics of the products he wishes to order. The Buyer, when selecting a product from the different categories offered, can, on each product page, have access to its detailed description showing its main technical characteristics (capacity, use, composition, etc.).

Klara J. reserves the right to modify the product mix depending in particular on the constraints linked to its suppliers.

The photographs, graphics & descriptions of the products offered for sale are only indicative & non-binding and do not represent an obligation on the part of the seller. In case a supplier modifies a product, the graphic representation of it can not engage the responsibility of the seller or even affect the validity of the sale.

The offers presented by Klara J. are valid for as long as stocks last. Our product offers and prices are valid as long as they are visible on the website, for as long as stocks last. The Buyer is informed, for each product, of its availability or not before placing an order. If a product is not in stock, the order cannot be made, thus preventing the Buyer from being charged on his credit card for a product that cannot be delivered to him. If, however, the order remains possible because of an error in the updating of our stocks we will inform the Buyer, by email or by mail, as soon as possible so that he can choose to wait for the product, replace it, or request a refund.

In the eventuality of long-term unavailability of products (more than 15 days), the Buyer's order will be automatically canceled and refunded.

Klara J. cannot be held responsible for the non-performance of the contract in the event of a stock shortage or unavailability of the product, force majeure, disruption, or total or partial strike, in particular postal services and means of transport and/or communications.

Article 4: Prices

The sale prices of products online on the website https://www.klaraj-shop.com/, indicated in Euros, are those in force at the time of registration of the order form by the Buyer. The prices indicated do not include delivery fees, invoiced in addition to the price of the products purchased according to the total amount of the order. In mainland France, for any order greater than 100 euros, shipping costs are free; for any order less than 100 euros, a contribution to the shipping costs will be invoiced to the Buyer, which varies according to the weight of the items chosen. This amount will be automatically calculated and will appear on the order form for validation. It is also possible for the Buyer to choose an on-site collect by choosing the option "Collect at the workshop". In this case, no shipping costs will be requested from the Buyer, who can come and collect their order from the workshop within 15 days.

Klara J. reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the Buyer. Any change in the VAT rate may be reflected in the price of the products.

If an order is made from a country other than mainland France, the Buyer is considered to be the importer of the product(s) concerned. For all products shipped outside the European Union and overseas territories, the price will be calculated excluding tax automatically on the invoice. Customs duties or other local taxes or import duties or State taxes may be payable. These rights and sums are not the responsibility of Klara J. . They will be the responsibility of the Buyer and are his sole responsibility both in terms of declarations and payments to the competent authorities and bodies.

The products sold remain the full and entire property of Klara J. until full payment of the price, including costs and taxes.

Article 5: Order

Before any order, the Buyer must create an account on the site https://www.klaraj-shop.com/, The account creation section is accessible directly from the header. During each visit, the buyer, if he wishes to order or consult his account (order status, profile, etc.), must identify himself using this information. Klara J. recommends that the Buyer keep this information on a paper or computer document.

Any order implies acceptance without restriction or reservation of these general conditions of sale. From the moment the Buyer has registered his order by clicking on the “Confirm your order” button, he is considered to have accepted knowingly and without reservation, these general conditions of sale, prices, volumes & quantities of the products offered for sale and ordered.

The Buyer's order must be confirmed by Klara J., by email. The sale will be considered final only after Klara J. will send a confirmation of the order to the Buyer and receipt by the latter of the full price.

Klara J. recommends that the Buyer keep this information on a paper or computer document.

Klara J. reserves the right to cancel or refuse any order from a customer with whom there is a dispute related to the payment of a previous order. In addition, Klara J. reserves the right to refuse orders and consequently deliveries without having to justify its decision in the event of a problem observed with the functioning of the database. This includes all attempts of fraud or bypassing the verification & security protocols put in place for the safety of the consumer.

Article 6: Payment

Payment of the full amount must be made when the Buyer makes the order All orders are payable in Euros.

The full amount of the order will be collected by Klara J. at the time of validation of the order.

To pay for his order, the Buyer has all the means of payment offered in the order form: payment card (credit card, Mastercard, Visa).

The Buyer guarantees to Klara J. that he has the necessary authorization to use the method of payment he has chosen when registering the order.

Klara J. reserves the right to suspend or cancel any order and/or delivery, whatever their nature and level of execution, in the event of non-payment of any sum due by the Buyer, or in case of payment incident.

Penalties of an amount equal to the legal interest rate plus 5% are automatically applied to unpaid amounts at the end of a period of ten days following the invoice date or upon notification of the rejection of bank payment for any other means of payment. The delivery of any new order may be suspended in the event of a dispute related to a payment of a previous order.

As part of the fight against fraud on the Internet, information relating to your order may be transmitted to any third party for verification.

Article 7: Delivery

Deliveries are made to the address indicated during the ordering process, which can only be in the agreed geographic area. Deliveries are made by La Poste or Colissimo (for prices > see detailed table below), delivery service with tracking, without signature. Delivery dates are only indicative; if these exceed one hundred days from the order, the sales contract may be terminated and the Buyer reimbursed. Klara J. will be able to provide the Buyer with the tracking number of his parcel by email. The Buyer is delivered to his home by his postman. If the Buyer is absent, he will receive a calling card from his postman, which allows him to collect the products ordered at the nearest post office, during a period indicated by the postal services. The risks associated with transport are the total responsibility of the Buyer from the time the items leave the premises. The Buyer is required to check in the presence of the employee of La Poste or the delivery person, the condition of the packaging of the goods and their contents on delivery. In the event of damage during transport, any protest must be made to the carrier within three days of delivery. If the shipping notice, the tracking number, indicates that the parcel/letter has been delivered and that the post office confirms that the parcel has been delivered to the address indicated, Klara J. will not be held responsible in any way and everything will be the responsibility of the Buyer.

Return

This amount will be automatically indicated and will appear on the order form for validation. It is also possible for the Buyer to choose an on-site Collect by choosing the option "Collect at the studio". In this case, no shipping costs will be requested from the Buyer, who can come and collect their order at the studio within 15 days.

These deadlines are provided for information only. Klara J. cannot be held responsible for the consequences due to a delay in delivery (force majeure, disruption, or total or partial strike in particular of the postal services and means of transport and/or communications) and any possible overrun cannot give rise to damages, deductions from pending payments or cancellation of the order by the Buyer.

In the event of items deliverable on different dates taking into account their availability, the delivery time is based on the longest time. However, Klara J. reserves the right to split deliveries. In this case, the information will be sent by email to the Buyer.

In the event of an error in the wording of the address making the delivery impossible, the additional costs incurred will be borne by the customer.

Article 8: Withdrawal - Cancellation - Refund

The Buyer has the right to cancel the order as soon as it is concluded, without any justification. He will need to follow the following procedure:

An acknowledging email confirming the request will be sent to the Buyer

In accordance to article L121-20 of the French Consumer Code, the Buyer has a period of fourteen working days from the delivery of their order to exercise his right of withdrawal and thus return the product to the seller for exchange or refund without penalty, with the exception of return costs, on the express condition that it has not been opened, damaged or broken and that it is in its original packaging (instructions, accessories, protective film...). If the Buyer uses this right of withdrawal within 14 days from the delivery of the product, the seller undertakes to refund the Buyer no later than thirty days following the date on which this right has been exercised. The postal costs of return will be borne by the Buyer, as well as the costs of sending back the package. In order to return his product, the Buyer must follow the following procedure:

The Buyer will be reimbursed by check within a maximum period of 30 days

Article 9: Responsability

In the distance selling process, Klara J., is only bound by an obligation of means. and cannot be held liable for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, interruption of service, or other unintentional problems

Article 10: Settlement of disputes

The parties agree that in the event of a dispute that may arise concerning the execution or interpretation of the conditions, they will endeavor to find an amicable solution. If this attempt to resolve the dispute amicably fails, it will be brought before the competent courts.

These general conditions of distance selling are subject to French law. For all disputes or litigation, the competent court will be the one of Montpellier.
